Conciliation Service

Conciliation is an early opportunity to help the parties to a dispute – Injured Workers, WorkSafe Agents, Employers and Self-insurers – achieve resolution through a process that is fair, economical, informal and quick.

Our Work

The primary objective of the conciliation service is to facilitate the efficient and appropriate resolution of workers’ compensation statutory benefit disputes in Victoria, which means that a more formal decision process will not be required.

Each party to a dispute is given an opportunity to participate and provide relevant information to ensure that disputes can be resolved at the earliest opportunity. A conciliation conference may not be required but this dedicated opportunity to bring the parties together remains central to what we aim to achieve – agreement and understanding.

The majority of disputes lodged with our conciliation service resolve there.

The Registry function is the public face and entry point of the Workplace Injury Commission, providing telephony and reception services and responsible for all aspects of our service delivery to support conciliation conferences and arbitration hearings. The Registry function includes the Client Services and Conciliation Support teams.

The Client Services team determines the jurisdiction and accurate registration of applications for conciliation and ensures that this process is undertaken efficiently and accurately.   The team comprises:

  • A Team Leader who is responsible for ensuring that accurate decisions are made at the point of receipt of a Request for Conciliation Form, thus enabling initiation of the conciliation process efficiently and effectively on behalf of the Workplace Injury Commission.
  • Client Services Officers who are responsible for providing first-line customer service, including reception, switchboard coverage and registration of requests for conciliation in line with the customer service focus of the Workplace Injury Commission.

The Conciliation Support team provides assistance and support to Conciliation Officers in gathering, analysing and documenting relevant information from all parties. The Conciliation Support team undertakes follow-up enquiries on behalf of Conciliation Officers. The team consists of:

  • Team Leaders who are responsible for the effective management of the administrative functions and the Conciliation Support team.
  • Information Officers who are tasked with providing prompt, high-quality service to all parties by providing information about conciliation procedures.

Our Conciliation Officers are supported by three Conciliation Officer Leads.

Conciliation Leads help Conciliation Officers deliver high-quality, timely and accessible conciliation services to support the fair, informal and cost-effective resolution of workers’ compensation disputes, in accordance with the Workplace Injury Rehabilitation and Compensation Act (Vic) 2013 (WIRC Act) and the Accident Compensation Act (Vic) 1985.

The primary function of Conciliation Officers is to consistently deliver the highest standard of technical knowledge and skills, aligned with the legislated duty of the Workplace Injury Commission - to be fair, economical, informal and quick, in an endeavour to bring the parties to agreement.

With integrity, diligence and a collaborative mindset, Conciliation Officer's will:

  • Resolve disputes by gathering and assessing information, identifying issues, and conducting fair and inclusive conciliation conferences.
  • Analyse, synthesise and manage high volumes of complex and confidential information.
  • Exercise powers on behalf of the Workplace Injury Commission, as set out in section 294 of the WIRC Act.
  • Provide leadership within the conciliation team and the Workplace Injury Commission as a whole, and contribute to policy development and ongoing learning to ensure delivery of the highest standard of dispute resolution service.
